Henry County BZA Has Full Schedule
(Note: This story expanded from one published in the May 7 issue)
May 7, 2008 - The Henry County Board of Zoning Appeals will hold a public hearing on Tuesday, May 13, 2008, at 7 p.m. in the Court House Annex Meeting Room, 101 South 12th Street, New Castle, to consider the following:
C:2216 - This being the request of White Branch Church,2044 North 900 East, Hagerstown, for a variance for rear setback of 3 feet instead of the required 50 feet for a carport on property zoned Agriculture (A-1) and being in Blue River Township.
C:2217 - This being the request of Bertie Shively, 8779 North Wilbur Wright Rd., Mooreland, IN 47360, for a variance for a temporary mobile home to be used for her granddaughter on a hardship case. This would also be the second dwelling on this parcel of land. Mobile home to be placed at 5390 East CR 950 North, Mooreland, and being in Stoney Creek Township.
C:2218 - This being the request of Herman Wattenbarger, 6761 North Raider Road, Middletown, for a variance for inadequate road frontage of 125 ft instead of the required 150 ft and 7.4 setback for a barn instead of the required 10 ft for an accessory building on property zoned Rural Residential (RR). Property located at 2274 North CR 650 West, New Castle, and being in Harrison Township.
C:2219 - Miranda Construction Group, 410 N., US 31, Suite 100, Whiteland, is requesting a variance to allow the old Stop 3 Truck Stop to come under new ownership and to expand under the current zoning of Highway Business-2 (HB-2) instead of General Business (GB) or Highway Business-1 (HB-1) with Commission Approved Use (CAU) which is required under our new Development Code. Their plans are to add truck wash bays to rear of building. They are under a time restraint and this variance will allow them to proceed at a quicker pace. Property located at 5809 South State Road 3, Spiceland, and being in Spiceland Township.
Other business Mark Clark, 1813 Columbia St., New Castle, received a variance to operate an auto repair shop at 3427 South State Road 103, New Castle, from the Henry County Board of Zoning Appeals (BZA) on October 3, 2006, Case C:2189. The variance limited the number of vehicles outside of the building to five. The zoning administrator has issued him a warning ticket for repeatedly exceeding that limit. He is challenging the ticket and requesting that he be allowed to have more vehicles on the outside of the building than what the variance originally allowed.
Approve Findings of Fact and Decision from the Nicole Paschal appeal case for a Home Day Care heard at the February 5, 2008 meeting. This approval has been tabled the last two months due to absence of Board members who were present at the February 5, 2008 meeting.
