County Planning Commission to Consider Amendment that Would Affect CAFO Sites
August 15, 2007 - The Henry County Planning Commission will hold a Public Hearing in the Old Henry County Circuit Court Room, 101 S. Main Street, New Castle, on Thursday, August 23, at 7 p.m. to consider the following:
Case B:2055 - This being the request of New Freedom Fellowship, represented by Danny Silvers, PO Box 314, New Castle, IN 47362, for a Commission Approved Use (CAU) for a church on property zoned Highway Business-2 (HB-2). Property located at 3001 Broad St., New Castle, IN 47362 and being in Henry Township.
Petition of the Henry County Planning Commission to amend Text of the Henry County Development Code, Zoning Ordinance.
Section 12.3 C. and Table 26: Part 2 should be amended to delete any reference to “residential uses” so that the minimum distance requirements for Commission Approved Uses relate to residentially zoned districts only and not to existing residential uses.
Section 12.3 C. as amended would read as follows:
C. Minimum Distance from Residential District
The uses may not be located closer to an RR, R1, R2, R3, or RMH District than the distance listed in Table 26, Commission Approved Uses: Part 2. Additionally, a parking area or loading berth for any of the following uses may not be located closer to a residential distract that the distance listed in the table.
Table 26. Commission approved Uses: Part 2, as amended would read “Minimum Distance from Residential Districts” Copy of proposed amendment is available at the office of the Henry County Zoning Administrator, 1201 Race St., New Castle.
Written objections to the proposal that are filed with the zoning administrator before the hearing will be considered. Oral comments concerning the proposal will be heard. The hearing may be continued from time to time as found necessary.
